Terms of use for Balane Play

1. Scope and contracting party

These terms govern the use of Balane Play, the game account operated by Balane GmbH, Balanstraße 84, 81541 Munich, Germany (Amtsgericht München, HRB 301320). They apply to every Balane game that offers Balane Play.

They do not govern the purchase of an app. The respective store’s terms apply there (see section 5).

2. What Balane Play is

Balane Play is a free account that works across all Balane games. It stores your username, your friendships and your scores, and makes them available on any device you sign in on.

Balane Play is not a subscription, not a sales platform and not a payment feature. There is no paid tier. Because no paid contract is formed, there is no right of withdrawal for Balane Play itself; for purchases in the stores, their withdrawal rules apply.

3. Accounts and guest accounts

You can create an account with an email address and password, or play as a guest. A guest account needs no email address.

• Your credentials are yours. Do not share them — whoever holds them can enter your account.
• A guest account is tied to the device and cannot be recovered without a stored email address. Lose the device and the progress is gone.
• Accounts are personal. Trading accounts or sharing one between several people is not permitted.
• You must be at least 16 years old to hold an account.

4. Usernames and content

Your username is unique across all Balane games and publicly visible — it appears on leaderboards and to your friends.

• Names must not be abusive, discriminatory or misleading, and must not infringe anyone’s rights. This applies in particular to names impersonating another person or Balane itself.
• If a name breaks these rules we will change or block it. Repeated breaches can lead to account suspension.
• Your friend code is not public. You decide who you give it to.

5. Purchases in the app stores

If a game or item costs money, you buy it on Apple’s App Store or on Google Play. Your contracting party for that purchase is the store, not Balane GmbH. Invoices, refunds and withdrawal are handled there.

Purchased rights apply per store. An App Store purchase does not unlock a Play Store install, or the other way round. The reason is technical: the stores give us no shared purchase history, so we cannot verify an Apple purchase on an Android device. To use an app on both platforms, it has to be acquired on each.

6. Rules of play

• No manipulating scores, no automated clients, no interference with the game or our servers.
• No harassment of other players, no using friend requests as spam.
• No attempts to obtain other users’ data that is not meant for you.

We may correct or remove scores that are evidently manipulated.

7. Suspension, deletion, termination

You can delete your account at any time — in the app or by mailing contact@balane.tech. Your profile, friendships and scores are deleted with it. Purchases already made in a store are unaffected.

We may suspend or delete an account that breaches these terms. For minor breaches we will give notice first where that is possible and reasonable. There is no claim to restoration of deleted data.

8. Availability and changes

Balane Play is provided free of charge. There is no claim to uninterrupted availability; maintenance, outages and changes to features are possible.

Should we discontinue Balane Play, we will announce it with reasonable notice and give you the opportunity to save your data.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

For ordinary negligence we are liable only for breach of a duty whose fulfilment makes proper performance possible in the first place and on whose observance you may rely, limited to the foreseeable damage typical for this type of agreement. Liability is otherwise excluded.

10. Data protection

What data we process and why is set out in our privacy policy. In short: your username and score are public on the leaderboards; your email address and friend code are not.

11. Governing law and dispute resolution

German law applies. Mandatory consumer protection provisions of the country in which you are habitually resident remain unaffected.

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12. Changes to these terms

We may change these terms, for instance when features are added or the legal situation changes. We will inform you of material changes in advance, in the app or by email. If you do not object and continue using Balane Play, the new terms apply.
